Navigating the AI-Driven Music Licensing Landscape: From the Radio Booth to the Algorithm
Abstract
This article explores the unprecedented challenges artificial intelligence presents to music licensing frameworks, drawing from industry insider experience at Creative Audio Enterprises, Inc. (DBA Holdcom)and personal experimentation with AI music tools. As AI-generated content disrupts traditional licensing models, legal practitioners must navigate evolving 2024-2025 litigation (RIAA v. Suno/Udio), state-level legislation (Tennessee's ELVIS Act, California's digital replica laws), and the systematic exclusion of creators from licensing negotiations. Through real-world examples and current legal developments - including Spotify's September 2025 removal of 75 million AI-generated tracks - this analysis provides guidance for counsel addressing AI music's impact on copyright, royalty structures, and creator rights. The article argues that sustainable AI music development requires inclusive frameworks that compensate all contributors while supporting technological innovation.
