Lifting the Lid on Serious Data Breaches

Abstract

This paper will highlight key elements of the proposed Australian data breach notification scheme together with the compliance challenges that Australian in-house counsel are likely to face. International counsel will benefit from an understanding of the extra-territorial application of Australian privacy laws and a comparison with other data breach notification frameworks, or lack thereof, in European and North American jurisdictions. Lastly, this paper will outline the broader impact of the proposed notification scheme on the developing privacy and data security frameworks which currently impact the technology industry.
