Compliance Monitoring

Abstract

One of the most relevant pillars of a compliance program is monitoring. The Brazilian Clean Companies Act (Law N. 12,846/13) provides that the compliance program will be evaluated according to the continuous monitoring of the integrity program aiming at its enhancement in the prevention, detection, and fight against the incidence of misconduct. The relevance of monitoring is also present in national and international regulations and guidelines, such as the Corporate Monitorship of the Department of Justice (DOJ), the OECD Anti-Bribery Convention, and the Brazilian Office of the Controller General (CGU), through the Integrity Guide.
