Human and the Loop: What are we Assuming About the Human?

Abstract

Most lawyers who regularly use generative AI have probably had the following experience. They ask an AI system to review a contract, summarise a regulatory development or produce a first draft of legal analysis. The output appears comprehensive and well structured. They review it carefully, perhaps disagree with parts of it, add further observations and move on. It feels as though they have exercised professional judgement over the AI’s work.
