Lease Break Clauses: Pitfalls for Tenants and Landlords
Abstract
Commercial break clauses remain a highly contentious area of landlord and tenant law. The recent economic downturn has seen landlords and tenants manoeuvring to protect their own financial positions. Whilst tenants seek to put themselves in bargaining positions for lease renegotiations or move to more favourable premises, landlords try to ensure that they receive continued rental streams and seek to challenge tenant’s attempts to exit leases.
