Practice and Procedure in a Representative State Court System

Abstract

This article examines civil practice and procedure at the pre-trial level under the “best practices” rules of the courts of the State of New Jersey. Although each of the fifty states has its own specific rules of practice and procedure arising out of its statutes, regulations and court rules, this article is intended to provide a starting point for foreign corporations and other business entities to understand what they may encounter if they sue or are sued in the courts of any state. The focus of this article is on the New Jersey “best practices” rules because, as their name implies, they are intended to be a model for civil state court practice and procedure.
