Dispute Strategies as Means of Additional Revenue

Abstract

This paper discusses and evaluates dispute strategies and the different aspects thereof. The concept of dispute strategy is analyzed mainly in three different contexts; Firstly, how dispute strategies can be build into contracts and how those strategies can be benefited both from enforcement and risk mitigation point of view. Secondly, analyzing the adoption of a dispute strategy at the dawn of the actual dispute and, finally, the commercial drivers and outcomes that the selected dispute strategy intends to achieve.
